1. Introduction
Welcome to MedNext ("the Platform", "we", "us", or "our"). MedNext is a digital healthcare technology platform that facilitates connections between patients (and their authorised caregivers) seeking home healthcare services and independent, qualified healthcare professionals.
By registering, accessing, or using the Platform (including our mobile application and website), you agree to be bound by these Terms & Conditions ("Terms"). Our collection and use of personal data is governed by our separate Privacy Policy. You will be asked to provide separate consent for processing of personal and health-related data as required under applicable law.
If you do not agree to these Terms, please do not use the Platform.
2. Nature of the Platform
MedNext is a technology marketplace that enables users to discover and book healthcare services at home. The Platform facilitates appointments with independent healthcare professionals including, but not limited to:
- Medical Doctors
- Registered Nurses
- Physiotherapists
- Dentists
- Other healthcare professionals as introduced from time to time
MedNext acts solely as a facilitator connecting patients with independent healthcare professionals. MedNext does not itself practise medicine, operate a hospital or clinic, or provide medical treatment, diagnosis, prescription, or nursing care. The contract for clinical services is between you and the attending healthcare professional.
Availability of specific services may depend on applicable professional regulations, licensing, and local laws in the service area (currently focused on Mumbai, Maharashtra, and such other areas as we may announce).
3. Eligibility & Minors
You must be at least 18 years of age to create an account and use the Platform in your own name.
If care is sought for a person under 18 years of age, a parent or lawful guardian must:
- Create and manage the account;
- Provide verifiable consent for the minor's use of the Platform and for processing of the minor's personal and health data; and
- Be present or appropriately available for home visits as reasonably required by the healthcare professional.
You represent that you have legal capacity to enter into these Terms and, where booking on behalf of another adult, that you are authorised to do so.
4. User Registration
Users must provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of login credentials and for all activities carried out using your account. Notify us promptly at the contact details below if you suspect unauthorised access.
5. Booking Services
Users may book healthcare professionals through the Platform based on stated availability. Appointments are confirmed only after successful booking and, where applicable, payment confirmation.
MedNext may reschedule or cancel appointments due to unforeseen operational circumstances (including professional unavailability, safety concerns, or force majeure). In such cases, we will notify you and offer rescheduling or a refund in accordance with Section 10.
Healthcare professionals may decline or terminate a visit if the environment is unsafe, information provided is materially incomplete or misleading, or continuing care would be clinically inappropriate.
6. Professional Responsibility
All healthcare services are independently provided by qualified healthcare professionals. Every healthcare professional is solely responsible for:
- Clinical examination
- Diagnosis
- Medical advice
- Prescription (where permitted by law and applicable practice guidelines)
- Treatment decisions
- Clinical documentation and medical records they create
- Follow-up recommendations
Medical decisions are based solely on the professional judgment of the attending healthcare provider. Any teleconsultation features, if offered, are intended to operate in line with applicable Telemedicine Practice Guidelines and professional regulations; the attending professional remains responsible for compliance.
7. Verification of Professionals
MedNext undertakes reasonable efforts to verify identity, qualifications, and professional registration credentials (for example, with the National Medical Commission / State Medical Council, nursing council, or other applicable regulators) before onboarding professionals.
Verification is limited to credentials and onboarding checks we perform at the time of review. It does not constitute a warranty of clinical quality, suitability for your condition, or any specific treatment outcome or recovery. Users should review professional profiles and exercise independent judgment when booking.
8. User Responsibilities
You agree to:
- Provide complete and accurate personal and medical information relevant to the booking and visit;
- Cooperate reasonably with the attending healthcare professional;
- Provide a safe and accessible environment for home visits;
- Treat healthcare professionals respectfully; and
- Not misuse the Platform or engage in abusive, fraudulent, or unlawful conduct.
You understand that outcomes may be affected if material information is withheld or inaccurate. Following medical advice is a clinical matter between you and the professional; these Terms do not create a separate contractual penalty for non-compliance with treatment advice.
9. Payments & Fees
Payments shall be made through the payment methods made available on the Platform. Card and payment-instrument data are processed by third-party payment service providers; MedNext does not store full card numbers on its servers.
Unless otherwise stated at checkout:
- The professional's service fee is charged for the clinical service provided by the independent healthcare professional; and
- MedNext may charge a platform, convenience, or service fee for use of the marketplace.
Applicable taxes (including GST, where applicable), service charges, and convenience fees will be shown before you confirm payment. The invoice or receipt will indicate the nature of charges as applicable.
10. Cancellation & Refund
Unless a different policy is clearly shown at the time of booking, the following applies to patient-initiated changes for confirmed paid bookings:

Platform, convenience, or third-party payment gateway charges may be non-refundable once payment is processed, except where the cancellation is caused by MedNext or the professional (for example, professional no-show or Platform-side cancellation), in which case eligible amounts including applicable platform fees will be refunded.
Approved refunds will ordinarily be initiated within 7–10 business days to the original payment method; the time for credit to appear depends on your bank or payment provider.
For medical emergencies, contact emergency services immediately (see Section 11). Emergency-related booking issues may be reviewed case by case by customer care.
11. Medical Disclaimer & Emergencies
MedNext does not practise medicine and does not replace hospitals, clinics, or emergency medical services. The Platform is intended only to facilitate access to healthcare professionals for non-emergency home healthcare where clinically appropriate.
If you are experiencing a medical emergency (including but not limited to chest pain, difficulty breathing, uncontrolled bleeding, stroke symptoms, severe allergic reaction, loss of consciousness, or suspected poisoning), immediately call local emergency services or go to the nearest hospital. Do not rely on the Platform for emergency response.
12. Limitation of Liability
To the extent permitted by applicable law, MedNext is not responsible for:
- Clinical decisions, diagnosis, advice, prescriptions, or treatment provided by independent healthcare professionals;
- Treatment outcomes or complications arising from clinical care provided by those professionals;
- Losses arising from incorrect, incomplete, or misleading information provided by the User;
- Delay caused by traffic, weather, or other circumstances outside MedNext's reasonable control.
Nothing in these Terms excludes or limits liability that cannot be excluded under Indian law, including liability for fraud, wilful misconduct, or gross negligence by MedNext, or liability arising from MedNext's own deficiency of service (for example, proven failures in Platform booking systems or credential checks we undertake), or rights you have as a consumer under the Consumer Protection Act, 2019.
Subject to the preceding paragraph, MedNext's aggregate liability arising out of or related to a particular booking, to the maximum extent permitted by law, shall not exceed the total fees paid by you to MedNext for that booking (including platform fees).
13. Intellectual Property
The MedNext name, logo, mobile application, website, software, content, graphics, and related intellectual property remain the exclusive property of MedNext or its licensors. You may not reproduce, copy, distribute, reverse engineer, or commercially exploit any part of the Platform without prior written permission, except as needed for personal, non-commercial use of the Platform.
14. Acceptable Use & Intermediary Role
You agree not to use the Platform to host, display, upload, modify, publish, transmit, store, or share any information that is unlawful, harmful, defamatory, obscene, invasive of privacy, or that infringes intellectual property or other rights, or that violates applicable law.
MedNext operates as an intermediary technology platform. We may remove content, restrict features, or suspend accounts where we receive actual knowledge of unlawful activity or as required to comply with applicable law, court orders, or government directions, and our grievance process.
15. Suspension and Termination
MedNext may suspend or terminate any account for fraud, misuse of the Platform, abuse of healthcare professionals, violation of applicable laws, or material breach of these Terms. You may stop using the Platform and request account deletion as described in our Privacy Policy and Account Deletion page, subject to legal retention requirements.
16. Indemnity
You agree to indemnify and hold harmless MedNext and its officers, employees, and agents from claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your provision of false or misleading information, except to the extent caused by MedNext's own fraud, wilful misconduct, or gross negligence.
17. Force Majeure
MedNext shall not be liable for failure or delay in performing obligations due to events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, riots, government actions, utility or network failures, or strikes.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified through the Platform, app notification, or email (where available) and will show an updated "Last Updated" date. Continued use after the effective date of changes constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
19. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of India.
Subject to your rights as a consumer under the Consumer Protection Act, 2019 (including the right to approach a competent consumer forum), courts at Mumbai, Maharashtra shall have jurisdiction over disputes arising out of these Terms.
Before filing a formal dispute, please contact our Grievance Officer so we may attempt to resolve the issue in good faith.

We aim to acknowledge grievances within 48 hours and resolve them within 15 days where reasonably practicable, or such other timelines as may apply under law.
21. User Acknowledgement
By registering on or using MedNext, you acknowledge that:
- You have read and understood these Terms & Conditions;
- You voluntarily choose to use the MedNext Platform;
- MedNext is a technology platform facilitating connections between patients and independent healthcare professionals;
- Medical advice, diagnosis, prescriptions, and treatment decisions are solely the responsibility of the attending healthcare professional; and
- Processing of your personal and health information is governed by our Privacy Policy and applicable law, including the Digital Personal Data Protection Act, 2023.
